LinkUp is operated by Forbes Digital Solutions ("we", "us", "our"), based in the United States, serving Jamaican businesses and their customers.
We are registered / in the process of registering as a Data Controller with Jamaica's Office of the Information Commissioner (OIC) under the Data Protection Act, 2020.

2. What Data We Collect

3. Why We Collect It (Lawful Basis under DPA 2020)
- Business listings: To provide the directory service (contract performance)
- Account data: To manage your subscription (contract performance)
- WhatsApp conversations: To operate the AI receptionist on behalf of the business tenant (legitimate interest + consent)
- Usage data: To improve the platform (legitimate interest)
4. How We Store and Protect Your Data
- Data is stored on Google Cloud Platform (GCP) infrastructure, primarily in the United States.
- Transfer of data outside Jamaica is governed by GCP's standard contractual clauses, which provide an adequate level of protection consistent with DPA 2020 requirements.
- We use encryption at rest and in transit, access controls, and audit logging.
- We do not sell personal data to third parties.
5. Your Rights Under the DPA 2020
As a data subject, you have the right to:
- Access your personal data
- Correct inaccurate data
- Object to processing in certain circumstances
- Request deletion of your data (subject to legal retention requirements)

6. Data Retention
- Business listing data: retained for the duration of the subscription plus 12 months
- WhatsApp conversation logs: retained for 90 days, then deleted
- Account data: retained until account deletion is requested
7. Data Breaches
In the event of a data breach affecting your personal data, we will notify affected parties and the OIC within 72 hours of becoming aware, as required by the DPA 2020.
8. Cookies
We use essential cookies to keep you logged in and remember your preferences. We do not use advertising or tracking cookies.
9. Third-Party Services
- Google Cloud Platform — infrastructure and data storage
- WiPay Caribbean — payment processing (their privacy policy applies to payment data)
- WhatsApp / Meta — messaging infrastructure (their terms apply to WhatsApp usage)
10. Changes to This Policy
We may update this policy. We will notify registered users by email of any material changes.
